The 2024 NASCAR season is embroiled in a fierce legal fight as negotiations over the 2025-2031 charter agreements reach a boiling point. 23XI Racing and Front Row Motorsports (FRM) have filed an antitrust lawsuit against NASCAR, refusing to accept the “take it or leave it” deal presented by the sanctioning body. The move has triggered a legal war with high stakes, including the potential collapse of both teams if the lawsuit doesn’t go their way.
To safeguard their participation in the sport, 23XI Racing and FRM have filed for an injunction to ensure they can still compete in 2025 while the case progresses. Recently, Denny Hamlin, co-owner of 23XI Racing, addressed the concerns of fans, assuring them that the team and its employees are protected against any fallout.
Hamlin emphasized the team’s preparation for any scenario and assured fans that the crew would not bear any financial burden, regardless of the lawsuit’s outcome. He and Michael Jordan, the team’s other co-owner, have pledged to absorb any financial impact themselves.
“We’re prepared for any outcome,” Hamlin stated. “Michael [Jordan] and I have made it clear to the team that we will not let this affect our employees whatsoever. Any financial distress is going to fall directly on the owners, not our people. We won’t allow any blowback to impact them.”
Hamlin explained that the injunction is crucial to prevent NASCAR from seizing their charters, which would cause irreparable harm to the team. He highlighted the pointlessness of winning the lawsuit if 23XI Racing no longer had its charters, underscoring the importance of the injunction in ensuring the team’s operations remain intact during the legal proceedings.
“We’re trying to stop NASCAR from taking our charters. Losing them would create massive irreparable harm,” Hamlin stressed. “We’re going to court to ask that we be allowed to operate as a chartered team while this lawsuit continues over the next year or two. If you lose your charters and later win the lawsuit, you can’t turn back the clock. It’s a critical issue.”
NASCAR currently holds the right to revoke the charters based on the existing agreement, which only extends until the end of this year. This makes the injunction a critical component of the ongoing legal battle for both NASCAR and the teams involved.
